1. ACTIVITIES COVERED

This Agreement applies to all activities conducted by Brooks Bros Jiu Jitsu ("Academy"), including but not limited to:

• Brazilian Jiu-Jitsu
• Gi and No-Gi training
• Wrestling and grappling
• Self-defense instruction
• Kids and adult classes
• Private lessons
• Open mat
• Sparring (rolling)
• Strength and conditioning
• Weightlifting and resistance training
• Functional fitness
• Cardio training
• Stretching and mobility work
• Use of free weights, barbells, dumbbells, kettlebells, racks, benches, resistance bands, cardio equipment, and any other training equipment
• Participation in seminars, competitions, demonstrations, special events, and activities on or off Academy property

2. ASSUMPTION OF RISK

I understand that participation in martial arts and fitness activities involves inherent risks that cannot be eliminated.

These risks include, but are not limited to:

• Bruises
• Cuts and abrasions
• Muscle strains
• Torn ligaments or tendons
• Joint injuries
• Dislocations
• Broken bones
• Concussions
• Neck and spinal injuries
• Paralysis
• Illness
• Heat-related illness
• Cardiac events
• Injuries from dropped weights or exercise equipment
• Injuries caused by other participants
• Permanent disability
• Death

I knowingly and voluntarily assume all risks, both known and unknown, arising from my participation.

3. RELEASE OF LIABILITY

To the fullest extent permitted under California law, I release and forever discharge Brooks Bros Jiu Jitsu, its owners, instructors, coaches, employees, independent contractors, volunteers, members, landlords, successors, and assigns from any and all claims, demands, causes of action, damages, losses, or liabilities arising from my participation in Academy activities, except where caused by gross negligence, reckless misconduct, or intentional wrongdoing.

4. MEDICAL CONDITION

I certify that I am physically capable of participating.

I understand it is my responsibility to consult a physician before beginning any exercise or martial arts program.

I agree to immediately notify an instructor if I become injured, ill, dizzy, or otherwise unable to safely continue.

5. EMERGENCY MEDICAL CARE

If emergency medical treatment is considered necessary, I authorize Brooks Bros Jiu Jitsu to obtain emergency medical care on my behalf.

I understand that I am solely responsible for all medical expenses.

6. RULES OF THE ACADEMY

I agree to:

• Follow all instructor directions.
• Treat training partners respectfully.
• Maintain good hygiene.
• Wear appropriate training attire.
• Keep fingernails and toenails trimmed.
• Remove all jewelry before training.
• Report injuries immediately.
• Use equipment only as intended.
• Re-rack all weights after use.
• Train within my physical abilities.

I understand Brooks Bros Jiu Jitsu may suspend or terminate my membership for unsafe or inappropriate behavior without refund where permitted by my membership agreement.

7. EQUIPMENT USE

I understand that improper use of exercise equipment or free weights can result in serious injury or death.

I agree to inspect equipment before use and immediately report damaged equipment.

I accept all risks associated with the use of fitness equipment.

8. COMMUNICABLE ILLNESS

I understand that participation in close-contact sports carries an increased risk of exposure to communicable illnesses.

I agree not to participate if I have symptoms of a contagious illness, including fever, vomiting, diarrhea, unexplained skin infections, ringworm, staph infection, or other contagious conditions.

9. PHOTO & VIDEO RELEASE

I grant Brooks Bros Jiu Jitsu permission to photograph or record me during training.

These images may be used for advertising, social media, websites, printed materials, and promotional purposes without compensation.

☐ I DO NOT consent to photo/video use.

10. PERSONAL PROPERTY

Brooks Bros Jiu Jitsu is not responsible for lost, stolen, or damaged personal property.

11. INDEMNIFICATION

I agree to indemnify and hold harmless Brooks Bros Jiu Jitsu from claims brought by third parties arising from my actions while participating in Academy activities, to the extent permitted by applicable law.

12. GOVERNING LAW

This Agreement shall be governed by the laws of the State of California.

Any dispute shall be resolved in a court of competent jurisdiction located in Santa Barbara County, California, unless otherwise required by law.

13. SEVERABILITY

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

I acknowledge that this document contains the complete agreement regarding assumption of risk and release of liability.

I have not relied upon any oral representations inconsistent with this Agreement.

ACKNOWLEDGMENT

I HAVE CAREFULLY READ THIS AGREEMENT.

I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR ORDINARY NEGLIGENCE TO THE EXTENT PERMITTED BY CALIFORNIA LAW.
